Biden Judicial Nominee Can’t Answer Basic Questions About the Constitution

Joe Biden wants to install a host of radical leftwing ideologues in the judiciary.

The problem with that plan was obvious from the start.

As Conservative Revival reports:

One of President Joe Biden’s judicial nominees ran into difficulties answering even basic questions about the Constitution.

Federal District Court nominee Charnelle Marie Bjelkengren struggled to find the answers when Sen. John Kennedy (R-LA) asked what Article V and Article II of the Constitution were designed for on Thursday.

“Thank you, Mr. Chairman, and congratulations to all of you,” Kennedy began. “Judge … on the far end. Tell me what Article V of the Constitution does.”

After a momentary pause, Bjelkengren replied, “Article V is not coming to mind at the moment” with a strained smile on her face.

What Article V of the Constitution explains is the procedure for amending the Constitution and how a proposal for an amendment can be put forward and how it can then be ratified.

“How about Article II?” Kennedy tried again.

“Neither is Article II,” was Bjelkengren’s response.

Article II of the Constitution defines the role Executive Branch of the American Government, it lays out how the president is elected, the qualifications thereof and the duties and powers of the role and the succession.

Okay,” Kennedy replied, scratching his head before moving on. “Do you know what purposivism is?”

“In my 12 years as an assistant attorney general and my nine years serving as a judge, I was not faced with that precise question,” she said. “We are the highest trial court in Washington State, so I’m frequently faced with issues that I’m not familiar with, and I thoroughly review the law. I research and apply the law to the facts presented to me.”

“Well, you’re going to be faced with it if you’re confirmed, I can assure you of that,” Kennedy warned.

Purposivism is a method by which judges sometimes choose to interpret statutes which stresses taking into consideration the purpose of a law or policy when interpreting it.

Biden nominated Bjelkengren to serve as U.S. District Court Judge in the Eastern District of Washington even though she doesn’t have the knowledge of the Constitution that is taught to high schoolers.

Judicial Network president Carrie Severino wrote on Twitter, “This is shocking to hear from a federal judicial nominee up for a lifetime appointment. Article II governs the Executive Branch.  This is basic middle school civics class stuff.”

“To be fair, Article V might be tough to recall on the spot. But difficult to excuse this judicial nominee’s drawing a blank on Article II,” Judicial Watch president Tom Fitton agreed.

“You can apparently make it through high school, get a BA, law degree, and sit as a judge on a federal court and still not be able to answer questions presumably related to your expertise that an 8th grader was typically required to know a century ago,” Daily Signal columnist Jarrett Stepman wrote.
